1. Agreement and eligibility
These terms govern your use of flowhaouz.shop and donations or support provided to Flow haouz, a Domestic Nonprofit Corporation located at 1345 Branson Ave APT 3B, Las Cruces, NM 88001, USA.
You must be at least 18 years old and legally able to authorize a donation. By completing a donation through a payment method Flow haouz makes available, you agree to these terms and the Refund & Donation Policy. Browsing the website or preparing an email inquiry does not authorize a charge.
2. Support options and currency
All amounts shown are in United States dollars (USD). A payment page or written confirmation will show the amount and frequency before you authorize payment. The current public support options are:
- Clean Water Access Sponsor: $49 USD per month, recurring until canceled. Intended to support clean drinking-water access for families through the organization's water-project mission.
- Community Well Project: $499 USD one time. Intended to support well construction and filtration installation within the organization's project portfolio.
- Infrastructure Partner: $1,999 USD one time. Intended to support community water-infrastructure construction and ongoing maintenance within the organization's project portfolio.
3. Recurring support and cancellation
The $49 Clean Water Access Sponsor tier is a recurring monthly donation. If you authorize it, the payment method is charged on the schedule disclosed at checkout until you cancel. The $499 and $1,999 tiers are one-time donations and do not renew automatically.
You may cancel recurring support at any time by emailing sajol.mikefrancisfil@gmail.com or using any self-service cancellation method provided by the payment processor. Cancellation stops future charges. Please submit an email request at least two business days before the next scheduled charge so we can process it before billing. If a charge occurs, the 30-day refund process remains available.
4. Donation allocation and project discretion
Tier descriptions explain the intended program area and scale of support. Unless Flow haouz accepts a legally restricted gift in a separate written agreement, donations support the organization's clean-water mission and may be pooled or reallocated among planning, site assessment, permits, materials, wells, pumps, filtration, storage, distribution, maintenance, monitoring, administration, payment fees, and other mission-related needs.
Project conditions, permits, local partnerships, weather, supply availability, safety, and community needs can change. Flow haouz may modify timing, location, method, or budget to use funds responsibly while advancing the mission. A donation does not purchase a specific physical item, ownership interest, naming right, or service for the donor.
5. Acknowledgment and project reporting
Donations are intangible mission support; no physical goods are shipped. When a payment processor or invoice is used, donors ordinarily receive an electronic transaction confirmation. Flow haouz may also provide project updates through the website or direct communications as information becomes available.
Project descriptions, timelines, budgets, and illustrations are planning information and may be revised. Flow haouz will not knowingly present an illustration, estimate, or planned initiative as a completed project.
6. Tax treatment
Formation as a nonprofit corporation does not by itself establish federal tax-exempt status or make donations tax deductible. Flow haouz does not promise tax deductibility on this website. Donors should verify the organization's current status with Flow haouz and the IRS Tax Exempt Organization Search, then consult their own tax adviser.
Any acknowledgment is a record of the transaction and is not tax advice or a guarantee of a deduction.
7. Refunds and payment disputes
Donors may request a refund within 30 calendar days after the applicable charge. The Refund & Donation Policy explains the request process, recurring cancellation, duplicate or unauthorized charges, and processing times.
Please contact us first so we can review a concern promptly. This request does not restrict any right to contact a bank, payment provider, regulator, or court, and does not shorten a mandatory legal deadline.
8. Website use and intellectual property
You may use this website for lawful personal and informational purposes. Do not interfere with the website, attempt unauthorized access, introduce malicious code, impersonate another person, or use the site to violate law or another person's rights.
The website's original text, identity, illustrations, and design are owned by Flow haouz or used with permission. You may not copy or present them as another organization's work without written permission.
9. Third-party services and links
Payment processors, email providers, mapping services, project partners, and linked websites operate under their own terms and privacy practices. Flow haouz is not responsible for an independent third party's systems, content, or acts, but this does not remove responsibility for our own conduct or obligations.
10. Disclaimers and limitation of liability
We work to keep website information accurate and to administer donations with reasonable care. The site is provided for general information, and project outcomes can be affected by conditions outside Flow haouz's control. We do not guarantee a particular construction date, community outcome, water volume, or uninterrupted website availability unless specifically agreed in writing.
To the extent permitted by law, Flow haouz is not liable for indirect, incidental, special, or consequential damages arising from website use or a donation. Our aggregate liability for a claim is limited to the amount the claimant donated during the 12 months before the event giving rise to the claim. These limits do not apply to fraud, willful misconduct, gross negligence, promised refunds, or liability that cannot legally be limited.
11. New Mexico law and disputes
These terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law principles, subject to any mandatory law that applies to you. Unless mandatory law requires otherwise, disputes may be brought in the state or federal courts serving Doña Ana County, New Mexico.
If any provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision once does not waive the right to enforce it later.
12. Changes and contact
We may update these terms prospectively as our operations or legal obligations change. The date above identifies the current version. An update does not retroactively remove refund rights or change an already-authorized donation frequency.
